1. Acceptance of Terms

By using prbarts.com, you agree to be bound by these terms and all applicable laws and regulations. If you do not agree, please do not use the site.

2. Intellectual Property Rights

All content, including but not limited to artwork, visuals, videos, 3D models, design elements, and written materials, are the exclusive intellectual property of PRB Arts and Peddalanka Ramesh Babu. No part of the content may be copied, modified, or distributed without explicit written consent. Unauthorized use may result in legal action.

3. Use of Content

All artwork, visuals, and written content are the intellectual property of PRB Arts. When you purchase a license, you are granted specific usage rights as defined in the Licensing page. You do not own or gain copyright.

4. Content Definitions: Masterpiece Collection vs. Elements Library

Our Service offers two distinct categories of content, governed by different terms of availability:

• The Masterpiece Collection: This refers to all assets available for license directly on prbarts.com, including photos, illustrations, vectors, videos, 3D models, and kits. These assets are exclusive to our Service and are guaranteed not to be sold on any other platform or stock agency.
• The Elements Library: This refers to our portfolio of assets available on third-party stock agencies, which may be found under our contributor names ‘prbarts’ or ‘Peddalanka Ramesh Babu.’ These assets are separate from the Masterpiece Collection and are created for a broader commercial market.

By using our Service, you acknowledge and agree to this distinction. The purchase of a license for an asset from the Masterpiece Collection does not grant any rights or claims over assets in the Elements Library, and vice-versa.

5. Prohibited Activities

You may not:

• Resell, redistribute, or share any content without permission
• Use content in illegal, harmful, or defamatory ways
• Use content in AI datasets or blockchain/NFT projects
• Attempt to reverse engineer or clone the website or assets

Personal Print-on-Demand (POD) use is allowed; commercial POD (selling on platforms like Etsy, Redbubble, Amazon, etc.) is prohibited. See the Licensing page for full details.

6. Custom Work

Any custom work created upon request is still copyrighted by PRB Arts. Unless otherwise agreed in writing, these works may also be published and sold through PRB Arts.

7. Accounts & Access

Users are responsible for maintaining the confidentiality of their account information. You agree not to share login details or allow unauthorized access to your purchased content.

8. Termination

PRB Arts reserves the right to terminate accounts or restrict access if terms are violated, without refund. Legal action may be taken in cases of abuse or infringement.

9. Disclaimer

All content is provided "as is" without warranties of any kind. PRB Arts does not guarantee uninterrupted access or error-free content. You use the site at your own risk. For a detailed explanation of the nature and limitations of our visual content, please review our full Disclaimers page.

10. Limitation of Liability

To the fullest extent permitted by law, PRB Arts and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the site or its content. In no event shall our total liability exceed the amount you paid for the specific content giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless PRB Arts, its owner, and affiliates from any claims, damages, or expenses arising from your misuse of the content, breach of these terms, or violation of any law or rights of a third party.

Note: PRB Arts does not provide indemnification coverage. Buyers are responsible for their own use of licensed visuals. See the Licensing page for details.

12. Delivery and Refund Policy

All sales of digital products are final and non-refundable. To ensure successful delivery, each purchased asset includes five (5) download attempts available from the user's dashboard. Should a user exhaust these attempts or experience a verified technical issue with a file, our sole obligation is to provide further download access or a working replacement file. Refunds will not be issued for technical issues that can be resolved through our support and redelivery process.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or related to these terms shall be subject to the exclusive jurisdiction of the courts located in Andhra Pradesh, India.

14. Modifications to Terms

These terms may be updated at any time. Continued use of the site after changes means you accept the updated terms.
